Agreement to Terms
Penlock ("the App") is owned and operated by Sugoi Group LLC ("Sugoi Group," "we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms of Use ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the App.
License
Sugoi Group LLC grants you a limited, non-exclusive, non-transferable, revocable license to use the App on any iPhone, iPad, or Android device that you own or control, for your personal, non-commercial use, subject to these Terms. Your use of the App is also subject to the terms of the store you got it from: the Apple Media Services Terms and Conditions for the App Store, or the Google Play Terms of Service for Google Play.
Free Use and the One-Time Purchase
Penlock is free to download. You can write up to 10 journal entries for free. A one-time in-app purchase unlocks unlimited journal entries.
- Price: The price is shown in the App and in the store before you buy. It may vary by region and may change for future buyers.
- Billing: Payment is charged to your Apple ID or Google Play account when you confirm the purchase.
- No subscription: The purchase is not a subscription. It does not renew, and you are never billed for it again.
- Updates: Future updates to the App are included at no additional charge.
- Restoring: You can restore your purchase on another device signed in to the same Apple ID or Google account by tapping "Restore Purchases." Purchases made on the App Store and on Google Play are separate and do not carry over between the two.
- Refunds: Refunds are handled by Apple or Google under their own policies.
Your Content
You retain full ownership of all content you create within the App, including journal entries, photos, tags, and any other data. Since all content is stored locally on your device, you are solely responsible for maintaining backups of your data. You can export your journal to Markdown at any time.
Acceptable Use
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:
- Attempt to reverse-engineer, decompile, or disassemble the App
- Remove or alter any proprietary notices or labels on the App
- Use the App in any way that could damage, disable, or impair its functionality
- Distribute, sublicense, or make the App available to third parties in violation of these Terms
Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Sugoi Group LLC be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or in connection with your use of the App, whether based on warranty, contract, tort, or any other legal theory.
Since all data is stored locally on your device, we are not responsible for any data loss resulting from device failure, damage, loss, or any other cause. We recommend regularly exporting your journal entries as a backup.
Intellectual Property
The App, including its design, code, graphics, logos, and all related intellectual property, is owned by Sugoi Group LLC and is protected by copyright and other intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.
Termination
We reserve the right to terminate or suspend your license to use the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App will immediately cease.
Changes to These Terms
We may update these Terms from time to time. Any changes will be reflected on this page with an updated "Last updated" date. Your continued use of the App after any changes constitutes your acceptance of the new Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
